$287,000 given to car accident victim By the Glenwood Post ASPEN – A Pitkin County jury has awarded $287,500 in the case of a 1990 injury accident on Highway 133 near Redstone, according to the attorney for the plaintiff. The award was assessed 75 percent against Robert Schwinger of Redstone, the key defendant, and 25 percent against the Colorado Department of Transportation. Schwinger was the driver of a vehicle that rear-ended another driven by Cindy Britton, who was injured in the accident, in a construction zone near the Penny Hot Springs the morning of August 28, 1990. Britton’s attorney, Dan Shipp of Aspen, had argued that Schwinger ignored the reduced speed limit and other posted warnings in the area when he came up on a group of cars following a street sweeper, including Britton’s, which he collided with. Schwinger’s insurance company had refused to settle the matter out of court, which Shipp said exposed Schwinger to the excess verdict. Shipp added that there’s no way to collect from CDOT, because it was not notified of a possible claim within the 180-day requirement. Britton contacted Shipp about 11 months after the accident.
